REFERENCE NO. 11 OF 2022 MALE H. MABIRIZI K. KIWANUKA v. THE ATTORNEY GENERAL OF THE REPUBLIC OF UGANDA

The Applicant alleges that the act of Respondent through its Agents of condemning the Applicant and Advocate Issac Ssemakadde for alleged twitter posts against Uganda High Court Judge Ssekaana without any Evidential basis or Hearing; Ordering the applicant Arrest and Imprisonment without summons and committal proceedings from the court; Justice of Uganda Court of Appeal in the Civil application No 40 holding that he lacked Jurisdiction to suspend Applicants Imprisonment by stating that he was functus officio and could not stretch rule 2(2) of the court of Appeal Rules thus declined the release of the Applicant contravene Article 6(d) and 7(2) of The Treaty for the Establishment of East African Community.
