Summary

The Applicant alleges that the act of the Respondent of not complying with the directives from the African Commission on Human and People’s Rights by adhering to the claims brought by the Applicant violated the Constitution of Kenya 2010; that African Commission on Human and Peoples Rights has deliberately failed to determine the merits on the admissibility of claimants Communications No 437/12, 439/12, 441/12 and 442/12 in absence of the Respondents written submission on statement of response for a period of about ten years; that the Respondents and the African Commission on Human and Peoples rights actions/omissions attribute to the delay of justice being upheld, hence contravening Article 6(d) and 7(2) of the Treaty for the Establishment of East African Community.
