REFERENCE NO. 15 OF 2023 BULLION REFINERY LIMITED & 2 OTHERS V. THE ATTORNEY GENERAL OF THE REPUBLIC OF UGANDA

The Applicants allege that Regulation 3 of the Mining and Minerals (Export Levy on Refined Gold) Regulations 2023 made by the Minster of Energy and Mineral Development of the Respondent State pursuant to section 287(2)(s) of the Mining and Minerals Act, Act No. 25 of 2022 contravenes Articles 5(1)(2)(3)(a)(g), 6(d), 7(1)(a)(b)(2), 8(4) and 75 of the Treaty for the Establishment of the East African Community, Section 172(1) and (2) of the East African Community Management Act 2004 and Article 23 of the Protocol on the Establishment of the East African Community Customs Union, 2004.
