Summary | The Applicant alleges that the actions, processes and decisions of Wafula Chebukati, Chairperson of The Republic of Kenya’s Independent Electoral Commission (IEBC) on Monday 15th August 2022 where he, (1) Unilaterally, against the majority of the members of IEBC announced final results of presidential elections conducted on 9th August 2022, (2) Proceeded in an environment of violence, confusion and uncertainty to declare the final results of presidential elections conducted on 9th August 2022, (3) Solely in absence of all members of IEBC declared what he termed national results of the 9th August presidential elections, (4) Signed, sealed and delivered what he termed final results of the 9th August 2022 presidential election without signatures of all members of IEBC are in violation of the Treaty for the Establishment of the East African Community.
