REFERENCE NO. 36 OF 2022 CHRISTOPHER SERAFINO WANI SWAKA v. THE ATTORNEY GENERAL OF THE REPUBLIC OF SOUTH SUDAN

The Applicant alleges that the act of the Respondent State through its agent the Ministry of Road and Bridges and its contractor illegally and without any agreement with the Applicant encroaching on part of the land in Gumbo Plot No. 1 Gumba Mix Farm 3rd Class Measurement 44500 square meters by constructing a road thereon without permission or compensation to the Applicant is an infringement of Article 6(d) and 7(2) of the Treaty for the Establishment of the East African Community.
