REFERENCE NO. 25 OF 2022 GEOFFREY KAZINDA v. THE ATTORNEY GENERAL OF THE REPUBLIC OF UGANDA

The Applicant alleges that the Respondent’s action of upholding the Applicant’s conviction and sentence on 6th November 2020, yet the Uganda Constitutional Court had in Petition No. 30 of 2014, issued an order to permanently prohibit the state from using a process of any court and the striking out the ground 2 of appeal which states that“ the learned trial judge erred in law and fact when she convicted and sentenced the appellant under a law which is not an offence and for which no punishment is prescribed, hence occasioning a violation of the appellant’s right to fair trial, on ground did not specify the law that was wrongly applied yet the applicable law was clearly stated in the submissions, charge sheet and indictment infringe Articles 6(d) and 7(2) of the Treaty for the Establishment of the East African Community
