REFERENCE NO. 33 OF 2020 EAST AFRICAN CIVIL SOCIETY ORGANISATIONS FORUM & ANOTHER v. THE ATTORNEY GENERAL OF THE REPUBLIC OF BURUNDI & 4 OTHERS

The Applicants allege that the 1st, 2nd, 3rd and 4th Respondents acts and/or omissions of failing to honour or pay their outstanding financial arrears owed to the community as per the Council of Ministers Directive 4th August 2020 violate their commitments to the fundamental and operational principles of the EAC specifically the principles of good governance and the rule of law as guaranteed under Articles 6(d), 7(2), Article 16 and 132(4) of the Treaty. The Applicants also allege that the 5th Respondent’s failure to comply with the Council directive in submitting the proposed schedule of sanctions to Partner States for their comments by 31st of August 20202 is abdicating or neglecting its functions under Article 71 of the Treaty and a breach of Article 16 of the Treaty.
